1. INTRODUCTION
These Terms of Service ("Terms") are a binding legal agreement between you and Gamespade Inc. (together with its subsidiaries, brands, and affiliates, including "Tarot & Horoscope Inc", collectively "Company," "we," "us," or "our"). These Terms govern your use of any and all mobile applications released by the Company on the Apple App Store or Google Play Store (collectively, the "Apps") and our website.
2. DISCLAIMERS FOR ENTERTAINMENT & PREDICTION APPS
IF YOU ARE USING ANY OF OUR APPS RELATED TO TAROT, HOROSCOPES, OR FORTUNE TELLING, THE FOLLOWING APPLIES:

Entertainment Only: The readings, advice, and predictions are strictly for entertainment purposes only. They are based on spiritual traditions and are NOT scientifically proven.

No Professional Advice: The content provided does not constitute medical, legal, financial, or psychological advice. You agree that any decisions you make based on our Apps are solely your own responsibility.
3. ELIGIBILITY

Minimum Age: You must be at least the minimum age required to consent to the processing of your personal data under the laws of the country where you reside (the "Minimum Age") to use our Apps. If you do not meet the Minimum Age required by applicable law, you are not authorized to access or use the Services.

Minor and Guardian Consent: If you meet the Minimum Age but are under the legal age of majority in your jurisdiction, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Compliance: By using the App, you represent and warrant that you possess the legal capacity and authority to enter into these Terms and that your use of the App complies with all applicable local, provincial, and national laws.
4. INTELLECTUAL PROPERTY
All Apps, including their code, graphics, text, and unique mechanics, are the proprietary property of Gamespade Inc. and are protected by international copyright laws.
5. PAYMENTS AND REFUNDS

In-App Purchases: All purchases are processed by the respective app store (Apple or Google).

Refund Policy: ALL SALES ARE FINAL. As digital goods, we do not offer refunds. However, refund requests are subject to the policies of Apple or Google, and you must contact them directly for any billing issues.
6. LIMITATION OF LIABILITY

Exclusion of Certain Damages: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMESPADE INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APPS.

Cap on Liability: IN NO EVENT SHALL THE COMPANY’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS (WHETHER IN CONTRACT, TORT, OR OTHERWISE), INCLUDING DIRECT DAMAGES, EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY FOR THE APP IN THE SIX (6) MONTHS PRECEDING THE INCIDENT; OR (B) ONE HUNDRED US DOLLARS ($100.00).
7. INDEMNIFICATION
You agree to defend and indemnify Gamespade Inc. from any claims arising out of your use of our Apps or breach of these Terms.
8. GOVERNING LAW & DISPUTE RESOLUTION

Governing Law: These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Class Action Waiver: You agree to resolve any disputes on an individual basis and waive the right to participate in a class action.
9. CHANGES TO TERMS
We may update these Terms at any time. Since we do not collect user emails, we will notify you of changes by updating the "Last Updated" date on this page or through an in-app notice. Continued use of our Apps constitutes acceptance.
